Over the weekend, House Oversight Committee Chairman James Comer (R-Ky.) wrote to the White House to inquire about property access. He called the issue “troubling” and wondered if the president had “jeopardised our national security.”
White House says Biden’s Wilmington residence had more classified documents.
“Like every President across decades of modern history, his own residence is personal,” said White House Counsel’s Office spokesperson Ian Sams. After the previous administration terminated White House visitor records, President Biden reinstated them and published them routinely.
Biden’s Wilmington house:
In November, Biden’s lawyers found a “limited number” of secret materials at the Penn Biden Center for Diplomacy and Global Engagement in Washington, where Biden worked after leaving the vice presidency. The president’s lawyers investigated his Wilmington and Rehoboth Beach, Del., homes and found the six new documents this month.
Biden has called the finding of classified information “surprising” and said he and his aides are cooperating with the Justice Department. He has also worked to distinguish himself from previous president Donald Trump, who refused repeated government demands to return all sensitive materials after leaving the White House, triggering a court-approved FBI raid of his Mar-a-Lago Club and Palm Beach, Fla., property last year.
The FBI collected about 300 classified and thousands of nonclassified federal papers from Mar-a-Lago. After Trump’s team informed federal investigators they had given over everything they could locate, agents found many of those papers.
Biden’s staff claims it willingly informed authorities of secret documents.

On Thursday, Attorney General Merrick Garland ordered a special counsel to investigate Biden’s former office and Wilmington residence’s handling of confidential documents. Garland appointed Robert K. Hur, a senior Justice Department official under Trump, to conduct the probe. Hur was appointed after Garland appointed Jack Smith, another special counsel, to investigate Trump’s residence’s secret document retention in November.
